These Terms & Conditions (“Terms”) govern your access to and use of any website, web page, estimate request form, online scheduling tool, text message line, or other online service (collectively, the “Site”) operated by:

  • Van’t Hof Concrete, Inc. (“Van’t Hof”)

  • Apex Concrete Pumping LLC (“Apex”)

Van’t Hof and Apex may be referred to individually as a “Company” and together as the “Companies,” “we,” “us,” or “our.”

By accessing or using the Site, contacting us through the Site, or submitting information to us (including requesting a quote), you agree to these Terms. If you do not agree, do not use the Site.


1) Important note about project contracts

These Terms apply to use of the Site and general communications. If you enter into a written proposal, work order, subcontract, invoice terms, or other signed agreement with either Company (a “Project Agreement”), the Project Agreement controls for that specific job to the extent it conflicts with these Terms.


2) Who the Site is for

The Site is intended for people and businesses seeking information about our services, requesting estimates, scheduling work, or contacting us.

You represent that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal authority to agree to these Terms.


3) Estimates, quotes, and scheduling

Estimates and quotes

Any information on the Site (including descriptions, photos, and general pricing guidance) is provided for general informational purposes and is not a binding offer.

Quotes/estimates may depend on factors such as site conditions, access, timing, material availability, scope changes, weather, permits/inspections, and third-party coordination. Unless a Project Agreement states otherwise:

  • Quotes may be revised if conditions or scope differ from what was represented.

  • A schedule date is a target and can change due to weather, staffing, equipment availability, jobsite readiness, or prior job overruns.

Your jobsite responsibilities (general)

You agree to provide accurate information and a jobsite that is reasonably safe and accessible, including (where applicable):

  • Clear access for trucks/equipment and adequate staging area

  • Disclosure of known hazards, obstructions, overhead lines, soft ground, septic systems, private utilities, etc.

  • Obtaining required permissions/approvals for access to private property


4) Safety and operational requirements

Because our work may involve heavy equipment, concrete placement, and/or pumping operations, you agree to:

  • Follow reasonable safety instructions given by our personnel

  • Keep children, pets, and unauthorized persons away from active work areas

  • Provide a safe and compliant work environment and cooperate with site safety rules (including those of a GC/site superintendent)

We reserve the right to pause or refuse work if jobsite conditions are unsafe or if access is not available, and you may be responsible for standby/trip charges if included in your Project Agreement or communicated in advance.


5) Communications and consent (calls, email, SMS)

When you submit a form, request an estimate, or otherwise provide contact information, you agree we may contact you by phone, email, or text about:

  • Your inquiry/estimate

  • Scheduling and project updates

  • Billing/invoices and service-related notices

Text messages

If you opt in to receive texts, you authorize us to send recurring messages related to your inquiry or project. Message and data rates may apply. You can opt out at any time by replying STOP (or by contacting us).


6) Payments, invoices, and chargebacks

Payment terms are typically defined in your Project Agreement, invoice, or proposal. If not specified, payment is due as stated on the invoice.

If you dispute an invoice, you agree to contact us promptly to attempt to resolve the issue before initiating a chargeback or payment reversal. Unresolved nonpayment may result in collections or legal action as allowed by law and your Project Agreement.


7) Permitted use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms.

You agree not to:

  • Attempt to gain unauthorized access to the Site, servers, or systems

  • Interfere with the Site’s operation (e.g., viruses, scraping, automated attacks)

  • Use the Site to send spam, fraudulent requests, or misleading information

  • Copy, reproduce, or exploit Site content except as allowed below


8) Intellectual property

All content on the Site (text, images, logos, videos, design, and layout) is owned by the Companies or used with permission and is protected by intellectual property laws.

You may view, download, and print content for your own non-commercial use related to considering or obtaining our services. Any other use requires written permission.


9) User-submitted content (photos, project details, files)

If you submit information through the Site (including photos, documents, or job details), you represent that you have the right to submit it and that it does not violate any law or third-party rights.

You grant the applicable Company a limited license to use that content to:

  • Evaluate your request

  • Provide estimates

  • Schedule and perform services

  • Maintain records for operations, safety, warranty, and billing

We do not treat estimate requests as confidential unless a separate written confidentiality agreement exists.


10) Third-party websites and tools

The Site may link to third-party websites or use third-party tools (e.g., maps, forms, analytics, scheduling). We are not responsible for third-party content, policies, or practices. Your use of third-party services is governed by their terms and policies.


11) Privacy

Our collection and use of personal information is described in our Privacy Policy(ies). If there is a conflict between these Terms and the Privacy Policy, the Privacy Policy controls for personal data handling. (Add your Privacy Policy link(s) here.)


12) Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Site will be uninterrupted, secure, error-free, or free of harmful components.

Project results and timelines can vary due to site conditions, weather, materials, and other factors. Any examples or photos are illustrative and do not guarantee identical outcomes.


13) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS/REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS RELATED TO THE SITE WILL NOT EXCEED $100 OR THE AMOUNT YOU PAID US THROUGH THE SITE (IF ANY), WHICHEVER IS GREATER.

(Some jurisdictions don’t allow certain limitations, so some of the above may not apply to you.)


14) Indemnification

You agree to defend, indemnify, and hold harmless the Companies (and their owners, employees, and agents) from any claims, damages, liabilities, and expenses arising from:

  • Your misuse of the Site

  • Your violation of these Terms

  • Your submitted content infringing third-party rights


15) Dispute resolution; governing law; venue

Informal resolution first

Before filing a claim, you agree to contact us and provide a brief written description of the dispute and your contact information, and allow a reasonable opportunity to resolve it.

Governing law and venue

These Terms are governed by the laws of the State of Iowa (without regard to conflict-of-law principles). Any legal action related to these Terms or the Site must be brought in state or federal courts located in Iowa, unless a Project Agreement specifies otherwise.


16) Changes to these Terms

We may update these Terms from time to time. The “Effective date” above indicates the latest revision. Continued use of the Site after changes means you accept the updated Terms.
